No appeal in hospital case

Former operators of Hillsboro Community Hospital last week lost their bid to appeal a January district court ruling that put the hospital into receivership.
Cohesive Healthcare Management and Consulting was appointed receiver by the district court in January after Bank of Hays filed a mortgage foreclosure lawsuit against hospital owner, CAH Acquisitions Company #5 and others with a financial interest in the hospital, including the city of Hillsboro.
In February, CAH Acquisitions appealed the district court decision.
In early March, the district court expanded Cohesive’s powers, and Cohesive filed for bankruptcy protection under Chapter 11 of the bankruptcy code.
Brent King was appointed bankruptcy trustee. In April, King filed a motion in appellate court seeking to dismiss CAH’s appeal of the appointment of Cohesive as receiver.
At first, the appellate court denied the request to dismiss the case, but changed its ruling June 6 after the bankruptcy court ruled the appeal case could be dismissed on the trustee’s motion.
