Wind farm lawsuit loses more plaintiffs

A second group of plaintiffs have withdrawn from a lawsuit over a conditional use permit granted to a planned wind farm.

Court documents filed Friday show 19 have withdrawn from the suit, originally filed Aug. 14 by Peabody farmer Randy Eitzen and 70 other plaintiffs.

That leaves 52 plaintiffs still active in the lawsuit.

Although the lawsuit targeted commissioners, Expedition Wind, the company developing the wind farm in the southern portion of the county, filed court documents Sept. 23 asking to intervene in the case, citing financial and property interests in its outcome. Permission to intervene was granted Oct. 16.

Plaintiffs withdrawing Friday include Dawn Cueller, Nasir Islam, Janet King, Judith Mellott, Alan Mellott, Thomas Pritchett, Vicky Pritchett, Helen Berns, Cheryl Marsh, David Marsh, Veronica Crabtree, Lindell Crabtree, Noreen Weems, Michelle Timmermeyer, Shelly Coover, Edwin Robinson, Jr., Larry Coover, Staci Janzen, and Jeffery Soyez.

They join seven other former plaintiffs who withdrew Sept. 24.

That group included Andrew Methvin, Laurie Methvin, Jeffrey Methvin, Rebecca Koehn-Kealy, David Keely, and Amy Stutzman.
