Wind farm litigants’ lawyers want out

A judge on Thursday allowed lawyers for four remaining plaintiffs in a lawsuit earlier filed against Marion County and Expedition to withdraw.

Now Florence resident Tom Britain stands on his own in the legal fight.

Overland Park lawyers Robert Titus and Robert Harken, earlier hired by Randall Eitzen and others to sue the wind farm and the county, later represented the group in a countersuit filed against them by the wind farm.

The lawyers claim Britain has not stayed in communication with them.

Eitzen himself and the wind farm earlier declared a truce and dismissed all claims against each other in both lawsuits.

Susan Mayo, Brandon Butts and Michelle Butts on Thursday dismissed their claims in the lawsuit against the wind farm.

The Buttses also dismissed their claim for expenses in the wind farm’s suit against them.

Mayo and Britain have not dismissed claims for payment of legal expenses in the lawsuit brought by the wind farm.
