Criminal division

The following information has been filed in the criminal division of Marion County District Court:

Johnathan Don Shultz, six counts of rape, sexual intercourse with a child under the age of 14, eight counts of aggravated criminal sodomy with a child, six counts of aggravated indecent liberties with a child under the age of 14, two counts of contributing to a child's misconduct; preliminary hearing continued from Feb. 20 to 9:30 a.m. March 5.

Debbie J. Orcutt, manufacturing of a controlled substance, possession of ephedrine or a derivative as a precursor as an illegal substance was amended to possession of ephedrine, sale etc. of opiates, opium, or narcotic drugs, possession of opiates, opium, or narcotic drugs, possession of anhydrous ammonia for illegal production of a controlled substance, no drug tax stamp as required, possession of a simulated controlled substance or drug paraphernalia; preliminary hearing was continued to 9:30 a.m. March 19.

David D. Orcutt, manufacturing of a controlled substance, possession of ephedrine or a derivative as a precursor as an illegal substance was amended to possession of ephedrine, sale etc. of opiates, opium, or narcotic drugs, possession of opiates, opium, or narcotic drugs, possession of anhydrous ammonia for illegal production of a controlled substance, no drug tax stamp as required, possession of a simulated controlled substance or drug paraphernalia; preliminary hearing was continued to 9:30 a.m. March 19.

Jordan Lee Trapp, two counts of giving a worthless check less than $500; first appearance hearing at 10:30 a.m. Feb. 25.

Brady May, arraignment hearing held, defendant pleaded not guilty to DUI and purchase/consumption of alcoholic liquor or cereal malt beverage by a minor; jury trial to begin at 8:30 a.m. April 30.

Michael G. Hemmer, preliminary hearing held, court found defendant partially indigent and appointed attorney David N. Harger, defendant ordered to pay $100 per month plus other fees, is to refrain from the use of alcohol or illegal drugs, and not drive a motor vehicle without a valid driver's license and proof of insurance; arraignment hearing at 9:45 a.m. March 11.

Albert D. Banks, sale or possession with intent to sell hallucinogens, possession of opiates, opium, or narcotic drugs, no drug tax stamp as required, possession of simulated controlled substances or drug paraphernalia; defendant pleaded guilty to possession of opiates, opium, or narcotic drugs, all other charges were dropped by county attorney; the crime was committed while incarcerated and serving a felony sentence or while on probation, parole, or conditional release; defendant was sentenced to 28 months with a Kansas Department of Corrections, upon release from prison will serve a 12-month post-release supervision, and ordered to pay court costs of $163 and $100 attorney fees.

Michael S. Nelson, aggravated criminal sodomy with a child amended to rape/sexual intercourse with a child, aggravated indecent liberties with a child under the age of 14 was amended to rape/sexual intercourse with a child under the age of 14, lewd/lascivious/ exposure to a child under the age of 16 amended to rape/sexual intercourse with a child under the age of 14, battery amended to aggravated indecent liberties with a child under the age of 14, three additional counts of aggravated indecent liberties with a child under the age of 14, two counts of lewd/lascivious/exposure to a child under the age of 16, and battery.
